sjratty, do you think NOK would state that they are negotiating even if they are negotiating while responding to IDCC's dismissal request. I thought that would give an excellent reason for the court to kick the case out...it would simply ask the parties to come back if the negotiations fail. Probably the negotiations stopped before that "no negotiations currently or planned for future" statement was made by NOK and they were not ready to come back to the table unless something changes on IDCC's side or stand.
