yes absolutely... judge should award some sort of damages to Sam in that case... just hope here but Sam had wanted/his intent was to take the Harp public I could see the judge awarding all of XMDC to Sam and making Ben and Paul pay all cost damaging XMDC. Just one of many scenarios..
