I think you are skipping the major factor, which is intent. Social security and insurance company death benefits weren't started in order to scam people. Madoff may not have started his plan as a way to fraudulently scam people. My guess he failed in his promises to investors. I'd say Stanford most likely did intend from the beginning based on his verbage to clientele.

Ahhh! BINGO! What fun! But, I digress.
