You fail to realize that NY Dec has approved JBII
False, the DEC has not approved any process of JBII. The DEC has a consent order that allows, not approves, of their process while awaiting permits.
Doesn't sound like the DEC is too optimistic about the JBII process. Why would they put fines into the consent order that force JBII to fill out permits, etc? From what I read, JBII doesn't even have the option to just withdrawal, they must apply for the permits, by certain dates with milestones being met or face fines. This is not good. The wording really makes it sound like this prcessor was built without approval from the DEC and now JBII is trying to get permits to operate it. The DEC web site makes it clear that approval and permits are to be had BEFORE building a machine like this. The fact that it is already build and operating with no permits is very telling. Sounds like the DEC is calling the P2O bluff.
