That's is the way how I see it, because we don't need to forget that NIR already settle with AVVAA and forgive them the penalties from before. and after the settlement AVVAA start pushing again. So basically my guess is that NIR has to give up some of ground because they are the one to loose more, at this time AVVAA does not care even if they go to bankcrupt, because is that is the option they will clean the mayority of the debt plus the directors will renegociate there shares for been prefered shares.
