No, but it'd be more interesting. Krazy Al would have to make specific allegations; he couldn't try the Bivens thing again, since Maheu doesn't work for the government.

So the case would be heard on its merits, or lack thereof. And Maheu would probably counterclaim, and accuse Al of all sorts of stuff.
