If they appeal the discovery decision then everything is basically at a standstill and you bet that means they have something to hide.

The next step would be to depose the hedgefund principals and you can bet that thats not gonna be pretty to be deposed for 3hrs while under oath and probably would be called to testify at the confirmation hearing.

The appeal would be their final blow, if the third circuit recommends that a TRUE valuation hearing is required to even proceed to confirmation then watch JPig and FrauDIC throw the hedgies under the bus.
