vg: Had I known then what I know now, I certainly would have put more emphasis on 'IMO'. But if you go back and read my post, I clearly stated that it was 'my impression.'

If you had listened in on my conversation with Janet, you would have come away with the same impression, and that is, that as far as Janet knows, there are no current ongoing discussions with Nokia.

It was first thing in the morning and she was responding to a e-mail that I sent last week. She was probably a little more forthcoming than she was with you (after reading all the posts on I_HUB ... lol).

She essentially said, 'We are largely done with the arbitration. Now, if Nokia comes knocking on the door, then that would be a different story...'

In my pea brain I think: If we were already in ongoing discussions with Nokia, then why would Nokia come 'knocking on the door?' Hence, my impression that there are now no ongoing discussions with Nokia.

You know, we all seem to think that the rational thing for Nokia to do is to try to reach an agreement with InterDigital now. First, what makes us think Nokia will behave rationally?

Second, what if Nokia is waiting on the arbitration decision before deciding whether to try to negotiate for a 3G rate. What is to prevent the parties from negotiating a 3G rate after the arb decision?

Somebody please remind me again on why Nokia would be better off negotiating a settlement before the arb decision. Does Nokia reduce its risk?
