i would be interested in knowing if the s.e.c's case
about the shares is correct....

Reread CMKX's most recent PR. They admit that much of their stock is unregistered. The ONLY shares that were registered in compliance with Section 12 were those they got from Cyber Mark when they did the reverse merger back in 2002.
