I think it would be more accurately stated that shareholders, not giving releases (eg, not compensated = no release given, or opting out of a distribution for the right of no release) are then able to sue accordingly.

It is probably incorrect to view the Equity Committee in a role to continue a lawsuit outside of the bankruptcy proceedings.
