I am not unhappy with the decision. I was hyped that the unsealing could change the course of the case, but just like the Examiners report being released and being detrimental to our efforts as shareholders, we have to take our lumps and move on. She has now thrown the report out the door and no references to it are allowed.

She did what she did and that is her decision..

As for the POR, if she approves that waste of paper, she will be setting an entirely new legal bk precedence and that will not be good for shareholders of BK companies, but will open a very large market for distressed post-bk hedge funds to run the bk process and I do not think she is going to allow the hi-jacking of her court like this. The 3rd Circuit is increasingly coming out against the financial crisis hedgies in their courtrooms.

The tribune lawyer (her associate) Judge Cary said NO,,,I will write the POR myself if you guys can not agree between all of you. He has the same problem, so in retrospect, I would think THJMW would side with her "down the hall" colleague.. At least that is what we are hoping for..
