TPS argument, I believe, is that the Caymans and other real estate backed securities had been seized on the 25th and therefore could not have been converted to J series or other relevant stock by WMI on the 26th regardless of OTS instructions. TPS wants the underlying mortgages back or more likely the value of them.

I may have misinterpreted so if you're interested you should poke around a bit.
