Blackstone functions as a financial advisor of sorts, hired by the debtors, so there could be the appearance (right or wrong) of being less partial.

The examiner was chosen by the US Trustee (after vetting the debtors and EC suggestions) and confirmed by the court.

The examiner is the boss; there is a presumption of impartiality.
