What this means is that Pleadings were due and the time period for Discovery in the case has ended, unless the judge extends it after the meeting on 29 Oct. We likely won't see any details of any type until early next week if there were any made on friday. We do not know if Discovery has ended, but per the court docket schedule, that was the requirement. It has appeared from the court filing by Markle requesting the pre-trial conference hearing on 29 Oct that the Daic parties have not complied with proper discovery. Markle referenced the fact that he was waiting for a return of his discovery request and depositions of the Daic parties. My guess is they have not complied yet. I believe Markle has an excellent point in wanting the Williamson firm to be removed from the case. I questioned this move when they originally replaced their prior legal counsel. How do you depose the attorney for Daic when he is the lead counsel for himself and Daic ? There are certain exemptions for an attorney to maintain information about his client through the attorney/client privilege. So was this a tactic to interfere with the legal process in the beginning when they made the switch, further stalling the case and creating more legal expenses for Calypso? Did they hope to get a quick win in the case by legal maneuvering, so they felt they could represent themselves and not have any legal expenses? Did the Williamson firm sign on thinking they could block any efforts to provide information they might have by claiming legal exemptions ? In my mind it's another attempt at trying to drain the resources of Calypso. Add it to the list for the court case. If I were the judge I would fine them for abusing the legal system. The Daic parties have to this point avoided having to answer the hard questions about their efforts and what they did for Calypso in the beginning. I believe the judge will see the Williamson firm will have to be removed as counsel and they will have to find a replacement. They will be ordered to be deposed and provide proper discovery. If not, this case could end up in the appeal process at a higher level. I don't think they realize yet that this is going to be a real attempt at getting justice, not a win without a trial or another agreement which further causes Calypso distractions. The game is over, it may take time, but it's over. I vote for making Markle's firm Calypso's legal counsel for future lawsuits, if he wins this one.
