Of course you know that's pedantic and rhetorical.

I was asked, if Rosen - based on my view of seeing him in action - could go forward in the face of the apparent problems. And I answered yes, Rosen could.

The DS/POR, as you know is being argued as meeting the bankruptcy standards of meeting the "minimum" required. And I feel Rosen would argue that, today. It's been a successful argument so far, and I'm confident he, if told by his hiring Debtors to march forward, would. I stand by that.

Your questions in your post are about whether he'd could or should win, what the judge could or should do, what Hochberg could or should do, etc, etc. I didn't say any of those things, nor was I asked.

That's a completely different subject. And if you'd like the board to discuss it, fine. But it's not what I said, and it's not what I was replying to.
