If Nok loses, they will pay. Using all the remedies available in the contract is one thing, but a groundless failure to pay an arbitration award is a very dangerous game. Absent undisclosed conflicts of interest of panel members, Nok would risk exemplary damage exposure for intentionally breaching the contract that placed the parties in the arbitration process.
