1. On April 6, 2010, Defendant Timothy M. Huff pled guilty to one count of 18 U.S.C. § 371, a dual-pronged conspiracy to defraud the United States, and to commit securities fraud in violation of 18 U.S.C. §§ 1348(1), 1348(2), and 1350(c)(1).
2. The defendant’s sentencing hearing is set for July 26, 2010.
3. In preparation for sentencing, the government has identified a number of investors who purchased and sold GlobeTel stock during calendar years 2002, 2003, and 2004 (the “investor list”). Each of the investors on the investor list lost at least one thousand dollars and no longer held a position in GlobeTel on December 31, 2004. The government plans to use this list of investors at sentencing and plans to call a sampling of the investors as witnesses at sentencing.
4. On June 21, 2010, the government provided defense counsel with a list of these investors, the dates on which they purchased and sold stock, and their loss amounts. In an effort to protect the witnesses’ privacy rights under the Crime Victims’ Rights Act, 18 U.S.C. § 3771(a)(8), the government redacted the witnesses’ personal information, including addresses and bank account information. . .
