It is interesting to note that in the District of Columbia case, WMI's motion to dismiss counterclaims of JPM at p 17 Peter Calamari then wrote: "In particular, the plain language of the Tax Sharing Agreement controls the right to tax refunds and it does not state anywhere that WMB or WMBfsb would "own" any tax refunds paid by the IRS to WMI, or that WMI would hold any such amounts in "trust". Furthermore, to the extent JPMC has a claim under the TSA, it is no different than any other creditor claim and therefore should be made in the bankruptcy proceeding."
