It wouldn't be a surprise for debtors, JPMC and the FDIC to 'wait and see':

1.) Who the examiner will be

2.) How tenacious the examiner will be

3.) What trail(s) the examiner will hunt

These 3 questions can be answered fairly quickly. Maybe less than 6 weeks. Maybe 1-2 weeks.

I don't think these guys want to go the distance with a proven, non-conflicted examiner. I expect settlement abruptly upon these 3 questions being answered in our favor. Until then, why shouldn't they feign confidence?

More than ever, I have every confidence that Sussman will do the job.
