Transcript of July 8th hearing.. Ok Team, I could not sleep, so I decided to delve into this delay we experienced today. One thing to keep in mind when reading this transcript is "Susman showed up and immediately talked with Rosen, Rosen smirked towards Ilenes. Susman and Nelson disappeared, then Rosen and some attorney's exited, then 2 from every delegation, etc.. was called into Chambers and all that's all she wrote."

Rosen: Your Honor thank you very much for allowing us to meet with you and discuss some issues in chambers and among the respected parties. Your Honor as a result of those, we believe there needs to be some uhm ongoing dialogue and we believe we need to make ourselves available on Monday to do that and as a result your honor we would like to adjourn what is on the calendar for today to July 20th which is already an omnibus hearing date and I think the courts calendar will permit us to move it from 10:30 to 9:30 so we can get all the matters on the calendar and heard that prior to the other matters the courts has and hopefully these discussions we are going to be having on Monday will yield an understanding with respect to the multitude of issues we are adjourning today.

THJMW: Alright and as I advised counsel. Well if there is a resolution, you can submit it to me and I’ll consider it before the 20th, I understand we want to keep matters moving.

Theory..

Susman Firm on behalf of the EC puts forth a Motion the "Seal Motion" which is confidential and will be instrumental to THJMW in helping her make the decision on the Examiner. I think the words were .. "The Document is relevant as to the issue of whether to appoint an examiner" They then follow up with..

"In light of the fact that the 2 motions involve similiar issues consideration of the seal motion as the same time as the court hears the examiner motion would benefit all parties in interest and conserve judicial resources.

Well as I advised counsel if there is a resolution, you can submit it to me, keep matters moving.

Resolution.. You need a RESOLUTION to RESOLVE A CONFLICT OF INTEREST!

Yes.. In April Rosen overstepped and PO'ed Susman by making him look stupid in the courtroom amid laughter by the other players. Susman just walked into the courtroom with a little payback and someone is getting conflicted out of this case. This is why you need a resolution and the same reason why most of the attorney's ended up in a Q&A with THJMW today. It does not look good that Rosen is going to be able to or needs to produce a resolution to satisfy her, so expect some interesting developments next week in light of the Conflict.
