Rosen said the discussions they will be having will hopefully yield some understanding to the issues that will be heard on the 20th. I suspect the discussions will be in reference to discovery issues and production of documents, but why wouldn't Susman raise hell and just ask for a ruling on the examiner. Maybe Rosen showed the judge that they are at least trying to get the EC everything they need so the examiner won't come in to play. The question is what can or will the judge consider before the 20th, if it were a settlement wouldn't she have to wait and make sure there aren't any objections to a proposed settlement? What do you guys think?
