The DOJ and the defendants again agreed to extend the date by which formal charges must be filed and the date by which a trial must take place by an additional 30 days. The filings were made on Friday and entered into the Pacer system today.
Again Metter's filing shows the checking of the "they need additional time to prepare for trial, etc." box and Moskowitz checked the "they are engaged in plea negotiations, etc." box. My unsolicited opinion remains that the different box checking is a necessary but meaningless formality.
Interestingly the new "expiration date" on the Metter filing is 8/6, while Moskowitz's reads 7/30. I'd guess one is using the filing date as a start date from which to measure the 30 days while the other is using the entry date, but I think they both would still be calculated incorrectly. I believe that formal charges would be due by 8/2, but who knows.
ps. Based on these filings, a trial would be required to begin in mid-September.
