I don't think settlement is possible imo. Things have progressed well beyond the point of no return between the parties and I'd be more surprised if we didn't get an examiner on the 8th than if there was a settlement that included equity. It may take longer to bring this to conclusion but I think getting an examiner is what we really need to get the most for equity.
