Lucent is well staffed..Poor IDCC is stretched to its limit currently engaged on two fronts with Lucent.One team has a January 31 deadline to mediate a resolution and the other team has asked the Court to permit an extension until January 21...If they can agree on only one claim and Infringement..IMO:Game,Set ,Match..


"Pursuant to the Court's Amended Docket Control Order, the parties have been ordered to
comply with Patent Rule 4-2 by January 10, 2005. Lucent Technologies Inc. ("Lucent") and
Tantivy Communications, Inc. ("Tantivy") are continuing their efforts to try and narrow the list
of terms and issues concerning claim construction. Accordingly, Lucent and Tantivy jointly
move the Court for Order extending the deadline to January 21, 2005 for the parties to comply
with Patent Rule 4-2."
The parties shall thereafter meet and confer for the purposes of narrowing the issues
and finalizing preparation of a Joint Claim Construction and Pre-hearing Statement.
