You are correct about the pinky’s – thus their high risk! Thus as to your above quote regarding the BOD, IMHO, the BOD has no direct fiduciary responsibilities to shareholders! That said, they DO have a duty to the court to produce these numbers (ala Susman/Solomon) and we (shareholders) of course should get them via the EC’s success! … rs
