I asked ACDU about providing a status of the audits because I thought they considered providing a status about the audits a violation of reg FD even via PR or some public method. But, they do not and seem to realize we would like an update.


ACDU Response:

"Issuing a press release would not violate Regulation FD in our opinion so long as the release was widely disseminated. However, advising shareholders when a press release may come about would violate Regulation FD.

Also advising you as to the content of a press release would violate Regulation FD.

We certainly take into consideration suggestions by shareholders as to what they would like notices about. The ultimate decision as to what to release goes to the executive staff.

My question:

"Could you please clarify your companies position regarding Regulation FD and forecasting filing dates / timing of events.

Is it your companies opinion that the company cannot estimate a filing date (IE announce when you expect to release remaining 10Ks) via a press release/8K because that will violate reg FD?"
