NO WAY AN EXAMINER GETS APPOINTED! I believe they will be working on a global settlement from here on in. They fought tooth and nail and spent countless hours arguing the reasons why an examiner should not be appointed and this last time stating that discovery and relaese of production documents had no bearing for the EC.
Its clear that they're are hiding something. We all know that and have known that. If the estate were truly out of money Rosen would have made that very clear and would have no problem showing the reasons of his POS POR. Rosen and company's agenda changed once they found the smoking gun and approached JPIG and FDICK. They decided to settle for as litte as possible, the current wamu estate would receive beneficial tax benefits re-organize and exit BK ....who knows even get some kick back money or "investment money" from JPM)
They almost got away with it. Now things have changed and as much as they attempted to bury this the hole was just too deep and things kept resurfacing.
THJMW has ruled in favor of us everytime, whether we see it or not. She is far more ahead of this as we think. The 4B ruling "as soon as possible" helped us in more ways than one....an EC for example and that ruling can still come at anytime and it will come down harder if Rosen and company dont settle, the tax benefits would not be split, and with NOls we are at A>L.

IMO they need to settle now more than ever. An examiner would find at least one smoking gun. Cause IMO there are several.... and they just cant cover all their tracks.
all of us at one time or another have suspected a settlement and have seen them in the filings, i believe we must have been included at one time or another but the winds changed and thank god for and EC we have power, otherwise we would all be using are stock certificates as toilet paper.

IMO the next hearing will either be the death of Rosen/JPIG/FDIC or simply that they are in negotiations with the EC, the EC will confirm that, they scrap the current POS POR and we will see a settlement come out sooner than we expect.

So to sum, I don't see the debtors and JPM/FDIC allowing an examiner. It is sure death.
It wont be smooth, the examiner will be appealed to death...but this case is far from over.
It hasnt looked any better for shareholders than now. Yet we sit at less than .14 amazing.
oh well more buying to be done i guess.
