Rose...correct me if I got it wrong... you say that PL didn't pay SL as promised in the asset agreement & judge will rule against PL for breach and either force PL to come up with the short fall dollars or allow SL to back out ...me thinks judge will not allow SL to destroy XMDC... harp is sole asset & he will protect SH and rule that a meeting of the minds did take place...the AG may have to be modified to the new reality between PL & SL...time has killed the original deal...
