Actually Large IMO: You are very wrong on this one. The Judge was probably on Vacation for the Memorial Day Weekend and will be back this week to sign whatever needs to be signed before the June 3rd hearing. If she does not sign the 2004 requests before then, it is because she wants to hear counsel arguments on the issue. You just don't lay down subpeona's on these parties without their side objecting.

I am sure the FDIC's lawyers are hard at work writing an objection to Discovery upon them and asking to be heard at the hearing. Now as for JPM, the tort claims warrant investigation of them, she should sign those before the hearing, unless JPM puts in an objection tomorrow.

As for Rosen. he pulled discussion on his DS and allowed his exclusivity to expire. Something happened there, because Weil is one of the best firms in the country, the pulling of the DS discussion is a "strategic move!" We should see competing POR's, with some just stating litigation awards alone are enough to approve theirs. I hope and pray Susman has had their team along with Solomon to draft a concrete POR and DS.

I am not a pessimist "like you" when it comes to our good Judge. I believe she is allowing the parties to prosecute this case and eventually hang themselves if necessary. As for the "all parties" statement she made about settlement and the "at this point" statement she made at the ruling on Examiner. Witnesses to the hearing have said "she was reading a prepared statement"

I beleive this Judge ABSOLUTELY knows what she is doing, just like Steve Susman said.. I will bet my holdings this way, you do what you like.
