Yes they can buy back shares, but have not since the end of Q3 2009. I believe there is a very significant reason for this, and I think it has to do with "safe harbor" provisions having to do with the value of stock used in an acquisiton, whether IDCC is the acquirer or the acquiree.

IMO, the unaccounted-for $6M legal expenditure for Q1 could very well have something to do with this possibility.
