Anadarko liability -
While I imagine APC has some liability for cleanup costs, it would seem that it should be entitled to indemnification from those actually responsible for the construction and operation of the rig. I do not know what an agreement between joint owners in an oil rig looks like, but I would be slightly surprised if, as between the owners, the non-operating partner had the same third party liability as the operating partner. As far as I know, APC hasn't raised this issue, perhaps because it would appear unseemly to do so now, but I believe Hackett's reference to "protecting shareholders" is, possibly, a backhanded reference to this.
