Austin01 a good part of the intellectual property is already protected by a series of patents from Adaptive (about 20 in all I believe)that NVEI owns. More to the point of your question though, patents do not have to issue in order for the core tech to be protected; patent pending status shows the patent office, and the world, that NVEI was the first in line to come up with the technology. This is assuming of course that no similar technology is already patented, and of course, none is. So NVEI is first, and in some way, protected by patent pending status.
