The flaw in your logic is that nicotine comes from tobacco plants, which "big tobacco" controls, so it's win-win for them. I presume that due to the simpler process involved, there is more profit in the manufacture of cigarettes.
If 'big tobacco" thought there was a way to profit from their product without the risk of suits for damages down the track, they would be first in line at the FDA.
