I agree , KKGD . With the SEC Formal Investigation and the litany of formal allegations in the Wells Notice Spongetech would need to be fully exonerated before they could claim damage from any other persons or sources . It would be assessed that Spongetech's inaction to the formal charges directly precipitated the onslaught of message board critics .

This lawsuit will be deemed premature and thereby frivolous and without merit .

And even if the Judge were to hear arguments the defendants would request and be granted full discovery of all materials pertaining to the very charges levied against the company , SM , MM , et al
by the SEC . In simpler words , SM and MM would have to provide evidence to refute the critics , the same evidence they apparently have not surrendered to the SEC .

Shirley the law firm representing S&M and M&M would know the case could not proceed under any circumstances . Since S&M and M&M are being sued by the biggest names on planet earth they probably don't care about any counter-suit ....the get at the back of the line thingy .
