Great post, however, don't think so... Here's why:

The deposits are fundamental to proving this whole case. The banks were solvent. To settle on just the money doesn't get either party off the hook for (a) the FDIC jumping the gun on a solvent bank and (b) discovery documents that prove that JMPC and the FDIC were in contact going behind Wamu's back to seize the bank. So to settle just on the deposit would (at least in my mind) make the rest of the case incurring a not-so-favorable settlement for JPMC and the FDIC. Plus you have other assets that weren't supposed to be seized.

Not a lawyer, and just my opinion.
