Bang... The Safe Harbor regs. apply to acquirers as well as acquirees and yes it could be acquired with the Nokia litigation ongoing.
Also, as I have stated before on this board, if a potential acquirer bid a 100% premium to the current stock price, the Board would have to think long and hard about instituing the rights distribution, lest they open themselves up to litigation. IMO
