Ummm....

do you think courthouse clerks decide what to file for a lawyer? Do you think that Hodges is not responsible for what is filed under his name? Come on now. But, lets say that the clerk did decide which summons to file. Why didn't Hodges, when he learned of the errant filing, take steps to correct it? Why did he have to wait for the clerk to send him a letter? Oh, I know, it was just an oversight....a slight detail.
