My opinion, which will not be popular, is that Walrath is going to send the 4.4 Billion decision to trial. SJ's are rarely given when requested, and there is a lot of complication with this issue. I believe she will deny the FDIC automatic stay, however I do not believe she will rule on this Friday - probably take it under advisement.

The 4.4 Billion issue is just too big, and too complex to simply issue a denial of SJ or SJ for WMI without all possibilities considered. That is why I feel it will go to trial where the decision can be even that much stronger.

People setting themselves up for a ruling on the FDIC automatic stay, and SJ for the 4.4 Billion Friday may be disappointed. I am always hopeful, but realistically this is huge piece of the pie in this case, and I can't see it getting resolved Friday.
