They can't...wasnt there something early on like a provision of something that would require the judge or someone to approve ownership to change hands if more than 5% of the shares were brought by someone to prevent such type of ownership...if memory serves me correct I believe this is the case. Anyone care to elaborate or confirm.

If this is the case as I believe it is than your scenario is not really possible.
