I am sure that JD will not be representing himself in the court, if it even goes that far.
So he would have requested an examination of the current situation and facts available, which in turn, his legal adviser would have analyzed the facts and determined within a high degree the probability of building a case.
Assuming the anyone involved is not a tremendously rich entity, any lawyer would instantly dismiss any case that wasn't a shoe in, unless of course copious sums of money were involved.
