hello Kali,
if you're talking about the case when judge turned down WAMU employees trying to get back their 401k money... that's completely different case from ours.This is what my friend had to say about it:
The lawsuit was against WMB (the bank) that was seized. They would have to sue the FDIC for the money, but tried to sue JPM for their lost retirement accounts. In the deal the FDIC made with JPM they would not be liable for things like this. WMI the holding company is suing for assets that were illegally taken by the FDIC and now held by JPM (again illegally). They want the assets back or the fair market value. The WMB bondholders are in the same position as these employees. WMI bondholders are different since their bonds were issued by the holding company and not the bank.
