Two things to remember

First Nokia apparently has already offered IDCC money, which says to me they are infringing, or they wouldn't make a offer.

Second IDCC is pretty sure they have the goods to eventually get a lot higher than what Nokia wanted to pay.

Now lets review if Nokia was willing to pay and we believe they was doing it because they was using the IDCC tehcnology, then how will they fare in a court when their hired experts say what a patent is worth? Their willing to pay in its on accord shows they are infringing, or would lead a lay person to believe it. Hence the chances of a Nokia win in my opinion in a civil court will be very very slim, and last I heard slim was on vacation.

Now with valid patents, and a offer to pay which is not even close to what you charge for your patents, I would say Nokia would be in a world of trouble, and settling is still their best venue.
