I was wondering when someone would bring this up. I strongly believe nothing will happen in terms of an agreed settlement until it is clear which direction the appeal will go, or is at least leaning towards.

Discovery is expensive. Depositions are expensive. Neither side is going to want to shell out the money or time until absolutley necessary.

Rolling discovery indicates to me another delay and longer wait, sorry. I do not expect anything significant to be produced until a motion to compel is granted in WMI's favor. JPM will produce a minimal amount of documents just so they can stand before the court, blink in utmost innocence, and declare they have been complying with discovery requests. That or they will begin producing documents in mass that reveal absolutely nothing and claim discovery is ongoing.

In the meantime, the pps will continue to fluctuate based on the current available news and perception about commons staying intact upon settlement/exit from bankruptcy.
