Question 1- Did JPM submit documents for discovery- She stated to her knowledge JPM did NOT submit documents for discovery. She stated Quinn is working with JPM on the "timeline and mechanism" for producing documents. She also suggested calling Quinn (I told her I did) to get the latest info. So I am going to call a few other people off of their billing statements to see what I can dig up.

Question 2- Are depositions scheduled- No.

Question 3- Weil's billing statement- "Hopefully this week". No other reasons given.

Question 4- Cancellation of equity- No plans to do so. No plan has been formulated so no plan to cancel equity is on the table.

Question 5- Emergence from BK in 3rd quarter- Off the table as of now due to the motion to extend exclusivity.

BTW, she reiterated that at the current time she did not expect equity to see a recovery. I wanted to clarify this. I stated that what she was saying was that as things stand now, A<L, equity does not see a recovery, but if the litigation and or settlement is successful that it would change everything to which she responded "yes". I just wanted to clarify this for those bashers that key in on that statement.

When talking about formulating a plan to exit BK, she stated that their latest motion for exclusivity should be used as a guide. I then responded that you will not exit BK until the litigation/settlement is completed and she responded that that was accurate.
