I think its preposterous that PXD is trying to strike the all the interveners. They have a separate filing to strike interveners Brown and Ginther because they say they did not actively help plaintiffs from 2005 forward or speak up until 2009. Thats a bunch of BS. First of all Brown and Ginther did not have to speak up before because the trial was ongoing and the lawsuit was always on behalf of all unitholders. Furthermore Ginther and Brown didnt even have to be unitholders in 2005. The only thing that matters is that they are unitholders now and as unitholders they have every right to object to this deal that they feel cheats unitholders. Hey Gibbs you moron, this settlement proposal that Brown and Ginther are reacting to didnt come out until 2009!!!! What Gibbs is basically saying to Ginther and Brown is that their units dont count. Well Texas Trust Laws say that their units have equal value to any other units and these unitholders have every right to be heard. I hope these two interveners have good counsel to make a strong argument against this attempt to silence these guys. I certainly would be willing to contribute to them monetarily.
