This is why I love to hear from you Mordicai. I was trying to make that assertion. JPM can say what they want to the court, but it has to be verified by independent auditors. It is not hard to do this when it comes to deposit records. I mean how do you lose 4Bil in deposits, It is impossible and as we know JPM is claiming them as assets.......... SO we know the money is real, but JPM is asserting is "air currency" and therefore the adversary proceeding should decide its fate.. HUM !!!

I loved the part in the Motion to Dismiss...
JPMC's complaint also alleges that between Sept 19 and Sept 24 in the days immediately preceeding the FDIC receivership WMI directed the recording of various book entries purporting (HUM) for the transfer of approx 3.67bil from WMB to WMB fsb (did the FDIC seize this one?) on sept 24 general ledger entries were posted with a "retro" date of sept 19 (so) that describes it as WMI contributing to FSB (well I never could have guessed that argument) however no cash or other funds were actually moved to orreceived by WMB fsb (uh-oh BK 2004 can play here) in connection with the purported (here's that word again) transfer based upon these and other facts (now they have to be proven in a court of law BK 20004) JPMC's adversary proceeding seeks the money (why)?

This is garbage and of course Lawyer's have to argue a point for their clients, but I see contradictory terms here and I hope Judge Walrath see's the same thing and rules on 2 things.
1. If the money does exist as WMI released in their 10K on April 30, 2009, it will be verified and returned to the rightful depositor. WMI (heck it is probably the investment money from TPG) !!
2. The ruling on BK 2004 needs to be made to determine if this money does exists and how JPM claims it does not! If JPM is found to be falsely claiming to the court that the money is basically non-existent, then maybe the judge will order a full examination.
