Without a doubt they will settle. The FDIC will cover JPM's back and will be more willing for a settlement which includes JPM rather than paying damages and allowing WMI to go on the auction block and be bought out by the highest bidder (like GS). The headline in the paper will only read JPM completes buyout of Washington Mutual. No big deal. Back in September they really didn't know what Washington Mutual was worth and now they are just completing the deal. That is how the story will go. FDIC and JPM will "save face." However, it will cost them at least $30B. A court award could go much higher. Iam confident WAMU's lawyers are holding that over their heads.
