I stated that from my reading of Weils work product Weil thinks, assumes, or knows from research the fdic receivership did indeed have jurisdiction over the bank assets and the power to sell them once seized. It has chosen to sue for damages and not regain possession of the bank assets on the theory that the fdic had no right to take the bank in the first place and alternatively that it was required under the statute to sell them at a better price.
