If a company was trying to take over CMKX by buying all the shares the downside for the takeover company would be getting hauled into court with the MM's. With a Roger Glenn around if that takeover was hostile as I think your insinuating here (most likely scenario) then the potential for infinite liability exists.

With Edwards &Angell minding the fort IMHO no company in their right mind would expose it's business to such a potentially disastrous litigation. Simply not worth it.
