i love your thinking on this, and understand the philosophy to a degree. if, in (the) prior suit we sued under the guise of FC and it was disallowed, what pretense/guise/terminology are we suing under this time around? furthermore, what if the govt./fdic decides to indeed roll the dice and let it go to trial?? it could be yearrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrs at that point. dont forget, the govt. can fund lawyers to eternity. frankly, i dont think you are going to see the govt./fdic blink.
